Terms and Conditions Agreement

1. Acceptance of Terms
By booking any service, attending any training course, or utilizing this website, you agree to be bound by these Terms and Conditions. If you do not agree with all of these terms, you are expressly prohibited from using our Services and must discontinue use immediately.
2. Service Scope and Limitations
A. Certified Training Services (AHA CPR/First Aid)
- Certification Issuance: Successful completion and issuance of certification cards (eCards) are strictly contingent upon the participant's attendance, practical skill demonstration, and passing score on all written examinations, as mandated by the American Heart Association (AHA) or other certifying body.
- Card Validity: The Company is not responsible for validating or managing the expiration of a participant's certification card after the card has been issued.
- No Guarantee of Outcome: Successful completion of a course only certifies the attendee's knowledge and skill at the time of testing. The Company does not guarantee an individual's performance or any specific outcome in a real-life emergency.
B. Fire Extinguisher Inspection and Service
- Scope of Inspection: Inspection and service are performed by a Texas SFMO Licensed Inspector according to NFPA 10 standards and Texas state regulations. Our service certifies the condition and operability of the equipment only at the time of inspection.
- Liability Exclusion: The Company is not responsible for equipment failure, damage, or misuse that occurs after the inspection is complete, or for pre-existing or latent defects in the equipment.
- Customer Responsibility: The Customer is responsible for ensuring the accessibility of the equipment, maintaining the equipment between inspections, and notifying the Company of any damage or changes.
3. Payment, Cancellations, and Refunds
- Pricing: All prices for training and services are as quoted to the client, either on the website or in a formal service agreement, and are subject to change upon notice.
- Payment Terms: Payment for training courses is generally due in full prior to the course date. Payment terms for inspection and service contracts will be outlined in the corresponding service agreement.
- Client Cancellation:
- All cancellation requests received less than 7 days prior to the training date will be processed as non-refundable. Hands and Hearts Safety Solutions reserves the right to review each cancellation on a case-by-case basis, but we do not guarantee any refund, credit, or class transfer for late cancellations. Any monetary return or credit extended will be solely at the Company's discretion.
- Inspection/Service: Cancellation terms are governed by your Master Service Agreement.
- Company Cancellation: The Company reserves the right to cancel or reschedule any service or class due to unforeseen circumstances, low enrollment, or instructor availability. In such an event, clients will be offered a full refund or a rescheduled date.
4. Intellectual Property and User Conduct
- Copyright: All content provided in our training materials, presentations, written reports, and on our website, including text, images, and logos, is the property of The Company and protected by copyright law.
- Prohibited Use: Training materials are for the sole use of the registered participant and may not be reproduced, copied, adapted, or used for commercial training purposes without the Company’s express written permission.
- Client Conduct: Clients and participants agree not to engage in any unlawful behavior, disruptive conduct, bullying, hate speech, harassment, spam, or other behavior that violates the rights of others or the safety of the training environment. The Company reserves the right to immediately terminate the participation of any disruptive individual without refund.
5. Termination and Modification
- Right to Terminate: We reserve the right to suspend or terminate service or access to our training and online platforms for any client who breaches these Terms and Conditions, fails to make timely payments, or engages in harmful or unlawful conduct.
- Modifications: The Company reserves the right to modify these Terms and Conditions at any time. The most current version will supersede all previous versions. Your continued use of the Services after the effective date of the revised T&Cs means that you accept and agree to the changes.
6. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action or proceeding related to the Services shall be brought exclusively in the state or federal courts located within Harris County, Texas.
